1. Acceptance of Terms

By downloading, accessing, or using Figure It Out ("the App," "we," "us," "our," or "Company"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, you may not download, access, or use the App. These Terms constitute a legally binding agreement between you and Figure It Out.

2. Description of Service

Figure It Out is a mobile application designed to help figure skaters of all levels track their skill progression and master figure skating techniques. The App provides:

  • A structured five-tier progression system aligned with skating skill development
  • Comprehensive skill tracking and progress documentation
  • Curated learning resources including videos, tutorials, and guidance
  • Video recording and playback functionality for self-analysis
  • Offline access to your progress and skill data
  • Optional premium features available through in-app subscription

The App is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the App at any time.

3. User Accounts

Account Creation

To access certain features, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and password, and for all activities that occur under your account.

You agree to:

  • Provide accurate, truthful, current, and complete information during registration
  • Keep your account information up to date and accurate
  • Maintain the confidentiality of your password and account access credentials
  • Notify us immediately of any unauthorized access or use of your account
  • Not share your account with other individuals or use another person's account
  • Be responsible for all activities conducted through your account

Account Eligibility

You represent and warrant that you are at least 13 years old (or the applicable age of digital consent in your jurisdiction). If you are under 18, you confirm that you have obtained parental or guardian consent to use this App. We reserve the right to request age verification at any time.

4. User Content and Recordings

The App allows you to create, upload, and store various types of content, including video recordings of your skating ("User Content").

Ownership and License

You retain full ownership of all User Content. By using the App, you grant Figure It Out a worldwide, non-exclusive, royalty-free license to store, process, backup, and display your User Content solely to provide the App's services to you.

Your Responsibilities

You are solely responsible for all User Content you create, upload, or store in the App. You represent and warrant that:

  • You own or have obtained all necessary rights to your User Content
  • Your User Content does not violate any third-party intellectual property rights
  • Your User Content complies with all applicable laws and regulations
  • You have obtained all necessary consents from individuals appearing in videos

Deletion of Content

You may delete your User Content at any time through the App's settings. However, we may retain backup copies for a limited period as part of our standard data protection practices.

5. Acceptable Use Policy

When using the App, you agree not to engage in any of the following prohibited behaviors:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to the App's systems, servers, or networks
  • Interfere with, disrupt, or place unreasonable loads on the App's infrastructure
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Use automated tools, bots, scripts, or scrapers to access or extract data from the App
  • Circumvent or disable any security features or protections of the App
  • Engage in any form of harassment, abuse, or threatening behavior toward other users
  • Impersonate another person or misrepresent your identity or affiliation
  • Submit false, misleading, or fraudulent information
  • Upload or share content that is obscene, hateful, defamatory, or otherwise offensive
  • Attempt to transmit malware, viruses, or other harmful code
  • Sell, transfer, or assign your account to another party
  • Use the App in a manner that violates these Terms or any other agreement with Figure It Out

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

6. Subscriptions and In-App Purchases

Pro Subscription

Figure It Out offers an optional auto-renewable subscription plan ("Pro Subscription") that provides access to premium features including unlimited video recording, cloud storage, and additional learning resources.

Pricing and Billing

All subscription pricing will be clearly displayed to you before you complete your purchase. Your subscription will be billed to your app store account (Apple App Store or Google Play Store) in the amount and at the frequency selected during purchase. Billing occurs automatically on the renewal date unless you cancel your subscription.

Auto-Renewal

Your subscription automatically renews at the end of each billing period unless you actively cancel it. You will receive a reminder notification before each renewal. You may cancel your subscription at any time through your device's app store settings or the App's settings menu.

Cancellation

To cancel your subscription, visit your device's app store account settings and disable auto-renewal for the Figure It Out app. Cancellation takes effect at the end of your current billing period. You will continue to have access to Pro features until the end of the current billing cycle.

Refunds

Refunds for subscriptions are governed by the policies of the Apple App Store or Google Play Store where you made the purchase. These policies typically allow refunds within a specific timeframe (commonly 14-15 days) after purchase. For refund requests, contact the appropriate app store directly.

Price Changes

We reserve the right to change subscription pricing. Any price changes will be notified to you in advance, and your continued subscription after the change constitutes acceptance of the new price.

7. Third-Party Content and Services

The App may contain links to third-party websites, applications, and content, including YouTube videos and other learning resources. We are not responsible for:

  • The accuracy, completeness, or quality of third-party content
  • The legality or appropriateness of third-party materials
  • The privacy practices or policies of third-party services
  • The availability or performance of linked external services

Your use of third-party services is governed by their respective terms of service and privacy policies. We encourage you to review those policies before using any third-party content or services.

8. Intellectual Property Rights

App and Content Ownership

The App, including all of its source code, design, features, graphics, text, audio, video, and other content (collectively, "Figure It Out Materials"), is owned by Figure It Out or its licensors and is protected by international copyright, trademark, and other intellectual property laws.

Limited License

Subject to these Terms, Figure It Out grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for your personal, non-commercial use. This license does not permit you to:

  • Modify or create derivative works based on the App
  • Reproduce, distribute, or publicly display the App or its materials
  • Rent, lease, or lend the App to others
  • Use the App for any commercial purpose
  • Remove or alter any copyright, trademark, or proprietary notices

9. Disclaimers and Assumption of Risk

Educational Tool Disclaimer

Important: Figure It Out is an educational tool and reference guide for figure skating skill progression. It is NOT a substitute for professional coaching, instruction, or medical advice. The App does not provide personalized training or medical guidance specific to your individual situation.

Assumption of Risk

Figure skating involves inherent physical risks, including the risk of serious injury or death. By using this App, you acknowledge that you assume full responsibility for any risks associated with your skating practice. You agree to:

  • Always practice under proper supervision, preferably with a qualified coach
  • Wear appropriate safety equipment including helmet, wrist guards, and protective padding
  • Follow all safety guidelines and recommendations from your coach or facility
  • Stop immediately if you experience pain or discomfort
  • Consult with a medical professional before attempting new or advanced skills

No Warranties

THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. FIGURE IT OUT MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Figure It Out does not warrant that:

  • The App will be error-free, bug-free, or continuously available
  • The App will meet your specific requirements or expectations
  • Any data or content will be secure or not lost
  • Any information provided in the App is accurate, complete, or up-to-date

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FIGURE IT OUT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF USE) ARISING FROM OR RELATED TO:

  • Your use of or inability to use the App
  • Any errors, omissions, or inaccuracies in the App's content or services
  • Any loss or corruption of User Content or data
  • Any injury or damage resulting from your skating practice or use of information in the App
  • Your violation of these Terms or any laws
  • Any third-party actions or content

IN NO EVENT SHALL FIGURE IT OUT'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO FIGURE IT OUT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY. IF SUCH EXCLUSIONS OR LIMITATIONS DO NOT APPLY TO YOU, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless Figure It Out and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the App or any User Content you create or upload
  • Any violation of these Terms or applicable laws
  • Any injury or damage resulting from your skating practice
  • Any infringement of third-party intellectual property rights
  • Any disputes with other users of the App

12. Privacy and Data Security

Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your personal information and User Content.

By using the App, you acknowledge that the internet and cloud storage are not completely secure, and any data you transmit is done so at your own risk. While we implement industry-standard security measures, we cannot guarantee absolute security of your data.

13. Termination

Termination by You

You may stop using the App and terminate your account at any time. You can delete your account through the App's settings menu. Upon termination, your access to the App will cease immediately.

Termination by Us

We may suspend or terminate your account and access to the App immediately, without notice or refund, if we determine that you have:

  • Violated these Terms or any applicable laws
  • Engaged in inappropriate, offensive, or illegal behavior
  • Failed to pay subscription fees (if applicable)
  • Used the App in a manner that harms other users or our systems
  • Created false or misleading account information

Effect of Termination

Upon termination, your right to access the App ceases immediately. You remain responsible for any outstanding subscription fees or other charges accrued before termination. However, certain provisions of these Terms survive termination, including Sections 8, 9, 10, 11, 13, and 14.

14. Changes to These Terms

We may modify these Terms at any time to reflect changes in our services, technologies, legal requirements, or other factors. We will notify you of material changes by:

  • Updating the "Last updated" date at the top of this page
  • Sending you an email notification (if material changes)
  • Displaying a notice within the App

Your continued use of the App after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the App and consider deleting your account.

15. Governing Law and Dispute Resolution

Governing Law

These Terms and your use of the App are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

Dispute Resolution

If you have a dispute with Figure It Out, we encourage you to first contact us to attempt to resolve the matter informally. Most disputes can be resolved through good-faith negotiation.

For any legal disputes that cannot be resolved informally, you agree that any legal action or proceeding will be subject to binding arbitration rather than court proceedings, except where prohibited by law.

16. Miscellaneous Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire and exclusive agreement between you and Figure It Out regarding the App and supersede all prior or contemporaneous communications, representations, or agreements.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by both parties.

No Assignment

You may not assign, transfer, or sublicense your rights under these Terms without our prior written consent. Any unauthorized assignment is void.

Survival

Sections that by their nature are intended to survive termination, including but not limited to Sections 4, 8, 9, 10, 11, 13, 15, and 16, will survive any termination of your account or these Terms.

18. Acknowledgment

By downloading, accessing, or using the Figure It Out app, you acknowledge that you have read these Terms of Service, understand them, and agree to be bound by them. If you do not agree to these Terms, you should not use the App. Your use of the App constitutes your legal acceptance of these Terms in their entirety.
